Purpose of the website

triptours.eu is a platform for selling tourist experiences in European cities, mainly free walking tours and day trips. Through the site, users can browse information about the different cities and products and either book directly or be directed to the relevant operator’s platform to complete the booking.

The site combines two types of products with different legal regimes, explained in the following section.

Business model: own tours and affiliate products

Trip Tours sells two types of products, with different legal regimes that should be clearly distinguished:

• Own products (free walking tours in Madrid and Sevilla): the free tours offered in Madrid and Sevilla are designed and operated directly by Trip Tours Madrid SLU, with our own guides, and are booked through the Donicus booking system integrated into the site. For these products, Trip Tours Madrid SLU is the service provider and sets the terms.
• Affiliate products (free tours in the rest of the European cities, and day trips): the free tours offered in the other European cities, as well as the day trips, are operated by partner platforms and operators, not by Trip Tours Madrid SLU. For these products, Trip Tours Madrid SLU acts as an affiliate reseller. The customer books and contracts the tourist service directly with the relevant platform or operator, and the specific terms (schedules, inclusions, cancellation deadlines and refunds) are subject to that operator’s policy in force at the time of booking.

Affiliate partner platforms

For affiliate products, Trip Tours directs users to the following partner platforms, with which the customer completes and contracts the booking directly:

• FreeTour.com: platform for booking free tours in European cities.
• GuruWalk: platform for booking free tours in European cities.
• GetYourGuide: platform for booking day trips and tourist activities.

Outbound links to these partner platforms are identified as affiliate links (with the rel sponsored attribute). Trip Tours Madrid SLU may earn a commission on bookings completed on those platforms, at no extra cost or surcharge to the user.

When booking a free tour in an affiliate city or a day trip through these platforms, the user contracts the service directly with the relevant operator or platform, whose specific terms will be communicated during the booking process. For the own free tours in Madrid and Sevilla, operated directly by Trip Tours Madrid SLU, it is Trip Tours Madrid SLU itself that provides the service and sets the terms.

General terms of use

• Acceptance of the terms: accessing and using triptours.eu implies unreserved acceptance of these terms. If you do not agree with them, please do not use the site.
• Permitted use: the user agrees to use the site only for lawful purposes, refraining from any activity that may damage, overload or interfere with its operation.
• Accuracy of data: the user is responsible for the accuracy of the data provided through the forms or booking processes, and for keeping it up to date.
• Changes: we reserve the right to change the content of the site and these legal terms at any time, and to suspend or cancel services without prior notice.

Intellectual and industrial property

All content on the site (text, images, logos, code and graphic design) is the property of Trip Tours Madrid SLU or is used under licence. Its reproduction, distribution, transformation or public communication without prior written authorisation is prohibited.

The trademarks, trade names and logos of the partner platforms and operators appearing on the site belong to their respective owners and are shown only to identify the products offered.

Liability

• Liability for affiliate products: for free tours in affiliate cities and for day trips, the actual provision of the service, the itinerary, schedules, inclusions, cancellations and liability towards the customer are the responsibility of the partner operator or platform (FreeTour.com, GuruWalk or GetYourGuide, as applicable), whose terms the customer accepts when completing the booking. Trip Tours Madrid SLU does not provide these services directly and is not responsible for their execution.
• Own free tours: for the free tours in Madrid and Sevilla, operated directly by Trip Tours Madrid SLU, the service terms are defined and provided by Trip Tours Madrid SLU.
• Third-party links: triptours.eu contains links to third-party websites (partner platforms, operators, social networks). We accept no responsibility for the content, availability, privacy policies or practices of those sites.
• Exclusion of liability: Trip Tours Madrid SLU will not be liable for technical errors or service interruptions beyond its control, for itinerary changes caused by force majeure, or for any misuse users may make of the site.

Applicable law and jurisdiction

These terms are governed by Spanish law. For any dispute arising from the use of this site, the parties submit to the Courts and Tribunals of Madrid, unless the applicable consumer regulations provide otherwise.
